Lettre ouverte aux ministères du commerce et à l'Organisation mondiale du commerce (OMC)

Il faut arrêter toutes les négociations de traités commerciaux et d'investissement pendant l'épidémie de COVID-19 et se recentrer sur l'accès aux fournitures médicales et le sauvetage de vies

Chers membres de l'Organisation Mondiale du Commerce,

Un nouveau coronavirus a provoqué une pandémie de COVID-19 qui s'est propagée dans presque tous les pays. On prévoit actuellement qu'il infectera des millions de personnes et causera des centaines de milliers de morts. L'Organisation mondiale de la santé (OMS) a demandé aux gouvernements d'adopter une approche pangouvernementale et pansociétale pour faire face à cette pandémie et de recentrer leur attention sur l’élimination et le contrôle du COVID-19.

De nombreux gouvernements le font déjà, au niveau national et local. Les gouvernements travaillent 24 heures sur 24 pour faire face aux défis sanitaires, notamment les pénuries de fournitures médicales, y compris de médicaments et de personnel de santé, qui mettent en danger la vie des patients, et ils se préparent à un choc économique mondial plus grave encore que la crise financière mondiale de 2008. Les fonctionnaires sont redirigés vers la lutte contre la pandémie, et les négociateurs commerciaux et les principaux décideurs ont déjà été infectés par le coronavirus.

Les pays ne disposent même pas d’assez de personnel et d'autres ressources pour traiter les aspects sanitaires de la pandémie. Ces pressions sont particulièrement intenses pour les pays en développement. Partout, les gouvernements sont confrontés à des pénuries de kits de test essentiels et d'autres fournitures médicales, telles que les équipements de protection individuelle, notamment les masques, les ventilateurs, les vaccins et les médicaments. Les vaccins et les médicaments potentiels pour traiter le COVID-19 sont en cours d'essai clinique et de développement et il n’est pas clair si la propriété intellectuelle va être un obstacle à leur approvisionnement, accès et accessibilité financière en raison des obligations actuellement applicables dans le cadre de l'accord de l'Organisation mondiale du commerce (OMC) sur les aspects des droits de propriété intellectuelle qui touchent au commerce (ADPIC) et des accords de libre-échange.

Compte tenu de cette priorité claire et urgente, nous sommes choqués que certaines négociations commerciales se poursuivent encore à l'OMC, ainsi qu'au niveau bilatéral et régional, en utilisant les technologies virtuelles. De nombreux pays en développement et pays les moins avancés ne peuvent pas participer, étant donné la fracture numérique et la nécessité de concentrer toutes les ressources gouvernementales sur cette urgence de santé publique. Les pays ne devraient pas non plus détourner leurs ressources pour négocier des règles pour un monde qui sera complètement différent une fois que la pandémie se sera calmée.

La première et seule priorité pour les négociateurs commerciaux à l'heure actuelle devrait être de supprimer tous les obstacles, y compris les règles de propriété intellectuelle, dans les accords existants qui empêchent un accès rapide et abordable aux fournitures médicales, telles que les médicaments, les appareils, les diagnostics et les vaccins vitaux, et la capacité des gouvernements à prendre toutes les mesures nécessaires pour faire face à cette crise.

Les sanctions unilatérales qui empêchent les pays d'obtenir des fournitures médicales essentielles doivent cesser.

Nous appelons les membres de l'OMC à faire en sorte que tous les pays disposent de la souplesse nécessaire pour mettre de côté les règles commerciales qui limitent leur capacité à résoudre la pandémie, sans crainte de conséquences, et à cesser les autres négociations et activités qui détournent leur énergie et leurs ressources de cet objectif.

Nous vous demandons en outre de reconnaître que la pandémie du COVID-19 nécessite de repenser fondamentalement les types de règles qui sont négociées dans les accords commerciaux, y compris celles qui peuvent encourager les monopoles et réduire l'accès abordable à toutes les formes de fournitures médicales, et mettre en danger la vie des personnes dans tous les pays du monde.
